1. GENERAL
1.1. novamapo.com is a website operated by NOVA Mapo One World AB (hereinafter referred to as “NOVA Mapo”, “us” or ”we”), a company registered in Deutschland and located at Ludgeristraße 20, 48143 Münster, Germany.
1.2. NOVA Mapo can be reached here for any question regarding these Terms and Conditions and matters connected to orders and purchase.
1.4. These Terms and Conditions govern the selling terms of all orders placed by customer(s) (hereinafter referred to as “you” or the “Customer”) on the domain novamapo.com, any sub-domains, mobile websites or the mobile application, from the moment you place an order until payment and delivery. By ordering a product, you agree to be legally bound by these Terms and Conditions.
Please make sure you have read and understood them before placing an order.
The Customer and NOVA Mapo are hereinafter collectively referred to as the “Parties”.
1.5. NOVA Mapo reserves itself the right to amend these Terms and Conditions from time to time. The new version will not be retroactive, and the Parties shall only be bound by the Terms & Conditions which are online the day the order is placed.
1.6. In these Terms and Conditions, the following terms shall have the meaning ascribed to them below:
a) “Site”means the domain, sub-domains of novamapo.com and mobile application.
b) “You” means the customer who places an order.
c) “Customer” means the individual who places an order. Purchases made on our Site are only to private individuals and not companies.
d) “Working Day” means a day which is neither (i) a Saturday or Sunday, nor (ii) a public holiday in the Customer’s country.
e) “Order” means the order submitted by you to the Site to purchase product(s) from us.
f) “Content” means all texts, graphics, videos, pictures and all other information published on the Site.
g) “Third Party Sites” means any site not provided by NOVA Mapo.
h) “Contract” means the order placed by you for the purchase of product(s) in accordance with these Terms and Conditions.
i) Words imparting the singular shall include the plural and vice versa.
2. ORDERING/ FORMATION OF CONTRACT
2.1. You may only purchase products from us if you are legally capable of entering into a binding contract with us, you are an authorised user of the payment method used to pay for your order. You may not purchase NOVA Mapo products for any commercial and/or business purpose.
2.2. Our Site will guide you step by step for finalizing your purchase and placing your order. You will be informed with a recap’ detailing the substantial information of your order before placing your purchase. We strongly recommend you to carefully verify all the details of your order before placing your purchase as we cannot guarantee that we will be able to amend your details afterwards.
2.3. Once you have placed your order, we immediately contact your payment provider for authorization to take payment from your account. We will not process your order until we have received such authorization . If you are using Klarna or Klarna pay in 3, others term may apply.
2.4. Once payment has been accepted, we’ll send you an e-mail to confirm the purchase. This email is acknowledgment of the purchasing contract between you and us.
2.5. NOVA Mapo reserves the right to refuse and/or block any purchase request made by you for legitimate grounds such as, for example, if we are not able to process your payment, if a product becomes out of stock or NOVA Mapo suspects that you purchase products for any commercial and/or business purpose. If a Product becomes out of stock between the time you place an order and the time our warehouse processes it, we will cancel the purchase of said product since it is no longer available. If this is the case, we will notify you and issue a refund. If for any reason we are unable to fulfill your order, you will receive a cancellation email. If payment has already been withdrawn for such cancelled order, we will refund the same amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, NOVA Mapo will contact you.
3. PRICING AND PAYMENT
3.1. Prices stated on the Site apply to all orders made through the Site. All prices are inclusive of VAT (where applicable). Delivery costs and any other costs which might apply will be charged in addition and are clearly displayed during the checkout process. In addition, you may be charged for customs and import charges as your order passes through customs. Any charges on a parcel must be paid by you (or the third party that acquires, physical possession of the items you purchased).
3.2. NOVA Mapo has the right to change or update information at any time without any warning, including errors with prices, details and descriptions which appear on the Site.
3.3. If an incorrect information has been specified for any product you have purchased, do not hesitate to contact our customer service under the conditions laid down in provision 1.3 of these Terms and Conditions.
3.4. We offer various types of payment methods. You will be able to find all the payment methods available for your country during the checkout process.
Please note that we do not accept cash or cheques.
3.5. All payments are subject to validation checks and authorization by the payment service provider you have chosen. If the provider refuses to, or does not for any reason, authorize payment, you will then be notified by email and/or during checkout. Other T&C might therefore apply.
3.6. If the provider refuses to, or does not for any reason, authorize payment, the order will be cancelled and you will then be notified by email and/or during checkout.
3.7. Occasionally, we may provide special offers and discounts relating to certain products on the Site. The conditions of use relating to any special offer or discount will be specified at the time of issue.
3.8. We reserve the right to withdraw such special offers or discounts at any time, without warning.
3.9 Please note that You are responsible for any costs associated with money transactions.
3.10 At checkout, you’ll be given the possibility to contribute to our sustainability investments and actions by donating a small amount around 10 SEK (may vary depending on your currency). By actively consenting to donate, you (i) agree to pay said fee and (ii) acknowledge that this donation is not refundable.
4. SHIPPING AND DELIVERY
4.1. Shipping costs will be charged in addition to the purchase price of your product, which is clearly displayed where applicable and included in the ‘Total Cost’ section at checkout.
4.2. We aim to dispatch orders within one (1) to two (2) working days following the confirmation email. Please note that dispatch time might take longer due to high seasons-sales, unexpected events or availability of product.
4.3. We will carry out a pre-authorization check on the card used for purchase to ensure there are sufficient funds to complete the transaction. The product you have purchased will not be dispatched until this check has been completed and payment has been captured.
4.4. You will receive a shipping confirmation email once your parcel has been dispatched, indicating an estimation of the time of delivery. The promised delivery time starts from the moment you receive your confirmation email.
4.5. Depending on where you are located, you will be given various delivery options. The amount of the delivery fee will depend on the delivery option you decide to choose. You will be able to find all the delivery methods vailable for your country during the checkout process.
4.6. You must provide us with a complete and accurate delivery address information as we cannot guarantee that we will be able to amend it after purchase. The customer is solely responsible for any error of delivery due to a lack of information or error on the delivery address while placing the order. Risk and ownership shall be transferred to you once the products are in your possession.
4.7. Our carriers will make every effort to deliver your order within the promised delivery time. Nevertheless, delays are sometimes inevitable. Please contact our customer service if you have not received your parcel within the promised delivery time.
4.8 Unless otherwise expressly agreed and if a delivery is delayed for more than 30 working days, you are entitled to cancel your purchase.
4.9. Should your parcel be delivered to a specific delivery point, you agree to pick up said package within the time specified in the delivery notification. Packages shall normally be retrieved personally with valid identification and order number. If you do not collect your parcel in time, your order will be sent back to us and fully refunded.
4.10. Our carriers do not deliver on weekends and public holidays. Please note delivery of your order may take longer during sale or other busy periods.
5. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
5.1 As a consumer you always have 7 days right of withdrawal, but we offer 15 days open purchase. Please note that you can only return products you have purchased through the Site.
5.2 Returns
5.2.1. Without prejudice to your statutory right of withdrawal (see below), you can return products (and gift cards!) for any reasons up to fifteen (15) days after receiving your order. Please use the return shipping label enclosed with your order. Contact our customer service should you have lost said label.
* Due to health and hygiene reasons, sealed cosmetics and hygiene products are covered by the right of return only when the seal is fully intact. Underwear and swimwear should have hygiene stickers remaining.
5.2.2. A condition for a full refund is that the goods are returned in the same condition as when you received the order. If the item has been used (other than to test it), damaged, washed, altered or missing tags/labels, we are entitled by law to charge you a fee for the depreciation of the item.
5.2.3 NOVA Mapo will provide you with a return label. You will be charged a return fee.
5.2.4. As soon as your return reaches our warehouse and has been processed by us, we will issue a refund. The return process can take up to two (2) weeks from the moment you send back your product. Once we have processed your return, you will receive a credit memo email. You will then receive your refund within two (2) to five (5) working days.
5.2.5 We do not offer exchanges for returned items. If you wish to purchase a new item, please place a new order.
5.2.6 All refunds will be made using the same method of payment you used to purchase the product. If you paid by invoice, your payment provider might need to contact you for issuing the refund. We shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than our standardised delivery method offered by us). Refunds shall not include any potential customs and import charges paid as well as your potential contribution to our sustainability actions (climate contribution fee).
5.3 Right of Withdrawal
5.3.1 You have the right to withdraw from a contract with us within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the items you purchased.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal written statement. Please contact us here. You may also use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is enough for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
5.3.2 Effects of withdrawal. If you withdraw from a contract with us and/or return any items, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than our standardised delivery method offered by us).
Refund shall be made without undue delay and in any event not later than 7 days from the day on which we are informed about your decision to cancel or until we have received from you evidence that the product has been sent, whichever is the earliest. You must return the items you no longer want not later than 14 days from the day on which you. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We will bear the costs of returning the goods provided you use the return shipping label provided by us for shipment from the country in which delivery was made to you, otherwise you will be required to pay the return shipping costs. We are permitted by law to reduce your refund to reflect any reduction in the value of the items, if this has been caused by your handling, including any loss or damage that occurs during transit.
5.4 Fair use policy
NOVA Mapo is committed to reducing its carbon footprint. We are constantly taking steps in order to reduce our environmental impact through, for instance, carbon neutral deliveries and returns, or sustainable collections.
While we pride ourselves in giving you a stellar customer experience, we take seriously any breach and abuse of our return policy.
Where appropriate and necessary, we shall investigate unusual pattern of return activities and take any necessary actions at our disposal. Should we have reasonable proof that you have systematically abused our generous return policy, we therefore reserve the right to refuse any future purchase requests made by you or to deactivate, temporarily or permanently, any of your account.
If your account has been deactivated and you believe we have made a mistake, kindly get in touch with our Customer Service. Above provisions do not prevent you from returning/claiming items that already have been purchased.
6. LEGAL GUARANTEE OF CONFORMITY
6.1. Should you find defects in the items you have purchased, NOVA Mapo abides by all statutory guarantee regulations. You have therefore up to 3 years from the moment you receive your items to claim your legal guarantee. You must act within a reasonable period of noticing the defect. A complaint made within 2 months is always considered to have been made within a reasonable timeframe. Please contact our customer service here.
7. GIFT CARDS & VOUCHERS
7.1 NOVA Mapo Gift Cards
NOVA Mapo Gift Cards can only be purchased on the website with a credit card. Each individual purchase of an NOVA Mapo Gift Card is limited to a maximum value of 1,500 SEK. The minimum value for an NOVA Mapo Gift Card is 100 SEK. You cannot increase or decrease the balance on your NOVA Mapo Gift Card once the purchase is completed.
NOVA Mapo Gift Cards are sent to the email address you provided at the checkout.
NOVA Mapo Gift Cards are valid for 12 months from the date of purchase. Once the validity period has expired, the NOVA Mapo Gift Card cannot be used as a payment method for purchases, cannot be reactivated, and the remaining unused value cannot be refunded.
Please contact our customer service if you wish to receive an NOVA Mapo Gift Card in a different currency.
NOVA Mapo Gift Cards can be used until the balance on the card is zero. If the balance on the NOVA Mapo Gift Card is zero, the card is invalid and cannot be reactivated or used again.
NOVA Mapo Gift Cards can only be used for purchases on the website and up to the balance available on the NOVA Mapo Gift Card. If you wish to purchase a product that exceeds the balance on the NOVA Mapo Gift Card, you will need to add an additional payment method to pay the remaining amount and complete the purchase.
NOVA Mapo cannot be held responsible for NOVA Mapo Gift Cards that are lost, stolen, or damaged after activation.
Orders made with an NOVA Mapo Gift Card should be returned or canceled in accordance with these terms and conditions and in accordance with our return policy.
Refunds will be issued to your NOVA Mapo Gift Card. If you have partially paid for your order with another payment method, you will receive your refund to the other payment method, and the remaining amount will be refunded to your NOVA Mapo Gift Card.
7.2 NOVA Mapo Voucher
In certain cases, NOVA Mapo may issue a voucher that can be used by the customer. The NOVA Mapo Voucher is created and sent to the email address you provided at the checkout. The voucher is valid for 6 months from the date of creation.
Please note that the NOVA Mapo Voucher can only be used for purchases on the website and up to the balance available on the voucher. If you wish to purchase a product that exceeds the voucher’s balance, you will need to add an additional payment method to pay the remaining amount and complete the purchase.
NOVA Mapo cannot be held responsible for NOVA Mapo Vouchers that are lost, stolen, or damaged after activation.
Orders made with an NOVA Mapo Voucher should be returned or canceled in accordance with these terms and conditions and in accordance with our return policy.
Refunds will be issued to your NOVA Mapo Voucher. If you have partially paid for your order with another payment method, you will receive your refund to the other payment method, and the remaining amount will be refunded to your NOVA Mapo Voucher.
8. LIMITATION OF LIABILITIES AND WARRANTIES
8.1. We make no warranties in relation to this Site or the information, materials, contents made available. We do not warrant that the Site will be continuously available, or the information on this Site is true, non-misleading or accurate.
8.2. Any information and contents on the Site should not be construed as NOVA Mapo giving advice of any kind.
8.3. You agree not to use any of our products for any commercial and/or business purposes, and we exclude liability for loss of revenue/profits, loss of contracts, loss of business, loss of opportunity or loss of reputation. Our maximum liability to you for any loss or damage arising in connection with your purchase on the Site shall be limited to the total price of your order.
9. TRADEMARKS
9.1. The trademarks, names and logos displayed on the Site are registered and unregistered trademarks of NOVA Mapo and/or its partners. Prior written permission from NOVA Mapo and/or its partners is required for use of any trademark, image or video from the Site. Thus, it is strictly forbidden to copy, reproduce, download, post, transfer or distribute any document which comes from the Site, in any ways.
10. PRIVACY POLICY
10.1. Please check our Privacy Policy which forms part of these Terms and Conditions.
11. CONFLICT OF TERMS AND CONDITIONS
11.1 If there is conflict or contradiction between the provisions of these Terms and Conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section of NOVA Mapo will no longer be valid.
12. SEVERABILITY
12.1 1If any provision of these Terms and Conditions becomes unenforceable or invalid in any jurisdiction, court or authority, the remaining provision and all other provisions will remain in full force and effect.
13. LAWS AND DISPUTES
13.1 These Terms and Conditions are governed and construed in accordance with Swedish laws.
13.2 Contracts concluded through the Site as well as any dispute arising out or in connection from them shall be governed by Swedish law. An amicable solution (through an ombudsman system) shall be considered before any judicial remedies. In the event where this solution would fail, Swedish courts shall have a non-exclusive jurisdiction to settle any disputes arising out from these Terms and Conditions. This provision shall not deprive European consumers from their national statutory rights.
13.3. In addition, and should you not be able to settle any dispute with NOVA Mapo, you can also submit complaint to the EU’s online dispute resolution platform. The Online Dispute Resolution platform is available via the following link: http://ec.europa.eu/odr.
13.4. In the event of a dispute or claim associated with these Terms and Conditions, we will comply with the decision of the Swedish National Board for Consumer Complaints or the corresponding authority in the respective country.

SECTION I – CIRCLE GENERAL TERMS AND CONDITIONS – SELLING AND BUYING SECOND-HAND ITEMS
These General Terms and Conditions and all below Sections referred to below (“Terms“) govern the selling and buying of second-hand NOVA Mapo items (hereinafter, the “Items”) listed and placed by customer(s) on the domain http://www.novamapo.com, any sub-domains, mobile websites or mobile application (hereinafter the “Site), for selling and buying second-hand NOVA Mapo items (hereinafter, the “Service”). The Sellers and Buyers will be collectively referred to as “Users”. The Users and NOVA Mapo are hereinafter collectively referred to as the “Parties”.

All Users should read the Terms carefully, as they affect their rights and liabilities, and ensure that they understand them, before using the Service. If a User does not agree to the Terms, she/he should not access and/or use the Service. By accessing or using any part of the Site and Service, You agree to be bound by these Terms and Conditions, including above additional terms and conditions and policies referenced herein and/or available by hyperlink.
By using the Service, NOVA Mapo will be involved as an active party between the Buyer and the Seller. Our Service is an online venue for individuals to buy and sell Items. During the performance of this online intermediary Service, Users acknowledge that NOVA Mapo’s role is to act as an active intermediary between Buyers and Original Sellers. Users therefore agree to use our payment and shipping services and agree to the terms related to such transactions.
We do not pre-vet any items listed on the Site or any parties who Users may deal with on the Site.
1. DEFINITIONS
In these Terms, the following terms shall have the meaning ascribed to them below:
Site: means the domain, all subdomains of www.novamapo.com and/or NOVA Mapo”s mobile application.
You: means the user (either Buyer or Original Seller) using the Service.
Customer: means the individual who uses the Service.
Order: means the order submitted by the Buyer to the Site to purchase listed Items.
Contract: means the order placed by the Buyers for the purchase of Items in accordance with these Terms.
Buyer: refers to a private person, or a pre-selected legal entity by NOVA Mapo, who wishes to buy or who’s bought one or more listed Item(s).
Terms: all provisions governing the use of the Service. The terms are made up of four parts: General Terms and Conditions, Selling Terms and Conditions, Buying Terms and Conditions & Privacy Policy.
Item (listed): refers to a fashion or beauty item previously bought on the Site and listed for sale by a Seller on the Site.
Delivery address: refers to the mailing address to which the bought listed Item will be shipped to the Buyer by the Seller.
Purchase Offer: refers to the revocable offer to buy one or more Item(s) on the Site.
Seller: refers to a User who offers one or more Item(s) for sale.
Shipping Fees: refers to the shipping fees set out by us based on our official courier’s fees
Original Seller: refers to a Seller who has previously bought an Item on the Site and wishes to sell it second-hand using our Service.
2. USE OF THE SERVICE
NOVA Mapo provides a free online feature on the Site through which our customers can buy and sell second-hand items previously bought on the Site.
The Service is an online marketplace for individuals for buying and selling pre-used Items to other individuals.
NOVA Mapo does not pre-vet any Items listed on the Service. During the performance of this online intermediary Service, You acknowledge that NOVA Mapo’s role is to act as an agent between sellers and buyers. These Terms are applicable to all Users of the Service and define the terms and conditions on which NOVA Mapo provides access to the Service allowing them to sell or buy Items.
The Service allows (i) Original Sellers to list Items on the Site, and (ii) Buyers to buy such Items. When listing an Item on the Site, Original Sellers agree to keep aforesaid Item under its good care. In return, NOVA Mapo promises to do its best to find buyers, host free of charge the listing on the Site and pay for shipping once the Item is purchased.
You acknowledge and agree that, by accessing or using the Service, You are indicating that You have read, understood and agreed to be bound by these Terms. If You do not agree to these Terms, You shall restrain using the Service.
The Service is intended solely for persons over the age of 18 years old. If You are under 18 years old, Your parent or guardian shall be responsible for supervising Your use of the Service at all times and ensuring that You comply with these Terms.
When required to provide information, You agree to provide accurate, current and complete information and to update such information to keep it accurate, current and complete. Please consult our Privacy Policy to check what information.
We do not allow multiple accounts on the Site.
You warrant that any information You provide to us is true, accurate and complete.
3. SUSPENSION AND TERMINATION
We may, at our own discretion, issue warnings, suspend, block or terminate access to the Service (or any part of them) or remove any content uploaded, including without limitation, any listed Item if:
- You are in breach of these Terms;
- You act in any manner which we consider may damage our reputation; or
- You use the Service in a manner which we consider to be fraudulent or contrary to law.
4. AVAILABILITY OF THE SERVICE
NOVA Mapo does not guarantee that the Service will always be available, uninterrupted or error-free.
We reserve the right at any time and without notice to enhance, modify, alter, suspend or permanently discontinue all or any part of this Service, or to restrict or prohibit access to it. By accepting these Terms, Users accept any such technical interruptions.
5. TRADEMARKS

7. CONFLICT OF TERMS
If there is conflict or contradiction between the provisions of these Terms and any other relevant terms and conditions, policies or notices, the provisions of these Terms shall prevail.
8. ASSIGNMENT
You shall not, in whole or in part, assign or pledge rights and/or obligations under these Terms without the written approval of NOVA Mapo.
9. SEVERABILITY
If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or part the validity of the other provisions of these Terms and the remainder of the provisions in question shall not be affected.
10.TRANSLATIONS
If these Terms must be translated into another language, the definitive version of the Agreement shall be the English language version, and any dispute in respect of the meaning of this Agreement shall be resolved by reference to the English language.
11. COMPLAINTS AND QUESTIONS
We take all complaints very seriously and try to resolve disputes as soon as they arise. Users wishing to make a complaint are encouraged to contact our customer care team as soon as possible using the following the form.

We keep these Terms under regular review. We will post any updates on this webpage. If significant changes are made, we will directly contact You by email so You can review the changes.

SECTION II – CIRCLE – BUYING TERMS AND CONDITIONS
These Buying Terms and Conditions govern the purchase of second-hand Items listed by Original Sellers on the Site. Please note that the purchase of regular (non-second-hand items) products and the selling of second-hand Items are not subject to the provisions set in below Section II.
1. GENERAL
NOVA Mapo provides a free online feature through which our customers can buy and sell second-hand items previously bought on the Site. The Service is an online venue for individuals for buying and selling pre-used NOVA Mapo items. The below provisions, and all other relevant conditions set in the Circle General Terms and Conditions, are applicable to all Buyers and define the terms under which NOVA Mapo provide access to the Service and allow them to buy Items.
During the performance of this online intermediary Service, You acknowledge that NOVA Mapo’s role is to act as an active intermediary between You, buyer, and Original Sellers. You therefore agree to use our payment and shipping services and agree to the terms related to such transactions.
You, as buyer, will purchase Items from NOVA Mapo. Buyers therefore acknowledge that the purchase transaction is made between the Buyers and NOVA Mapo.

NOVA Mapo does not pre-vet any items listed on the Service. Nevertheless, and since the Items are purchased from us, all Buyers benefit from the right of withdrawal and are covered by a mandatory three (3) years legal guarantee.
You acknowledge and agree that, by accessing or using the Service, You are indicating that You have read, understood and agreed to be bound by these Terms. If You do not agree to these Terms, You shall restrain using the Service.
The Service is intended solely for persons over the age of 18 years old. If You are under 18 years old, Your parent or guardian shall be responsible for supervising Your use of the Service at all times and ensuring that You comply with these Terms.
In order to access the Service, You must register an account. During the registration process, You will be required to provide certain information and You agree to provide accurate, current and complete information and to update such information when needed.

We do not allow multiple accounts on the Site.
Business buyers are not authorized to use the Service, unless NOVA Mapo has specifically approved in writing such use. By using the Service You warrant that You are not a business buyer.
You warrant that any information You provide to us is true, accurate and complete.
2. PRICING AND PAYMENT
Prices stated on the Site apply to all orders made through the Site. All prices are inclusive of VAT (where applicable). Delivery costs and any other costs which might apply may be charged in addition and are clearly displayed during the checkout process.
NOVA Mapo has the right to change or update information at any time without any warning, including errors with prices, details and descriptions which appear on the Site.
If an incorrect information has been specified for any product You have purchased, do not hesitate to contact our customer service.
We offer various types of payment methods. You will be able to find all the payment methods available for Your country during the checkout process.
Please note that we do not accept cash or cheques.
All payments are subject to validation checks and authorization by the payment service provider You have chosen. If the provider refuses to, or does not for any reason, authorize payment, You will then be notified by email and/or during checkout. If the provider refuses to, or does not for any reason, authorize payment, the order will be cancelled and You will then be notified by email and/or during checkout.
Occasionally, we may provide special offers and discounts relating to certain Items on the Site. The conditions of use relating to any special offer or discount will be specified at the time of issue.
We reserve the right to withdraw such special offers or discounts at any time, without warning.
Please note that You are responsible for any costs associated with money transactions.
3. ORDERING/FORMATION OF CONTRACT
Buyers shall find listed second-hand Items on the Site. A listed second-hand Item shall feature the mention “Pre-loved” on our product card.
Our Site will guide Buyers step by step for finalizing their purchase and placing their order. Buyers will be informed with a recap detailing the substantial information of their order before placing their purchase. We strongly recommend Buyers to check all the details of their order before placing their purchase as we cannot guarantee that we will be able to amend Buyers’ details afterwards.
Once an order is placed, we immediately contact Your payment provider for authorization to take payment from Your account. We will not process Your order until we have received such authorization. If You are using Klarna or Klarna pay in 3, others terms may apply.
Once payment has been accepted, we’ll send You an email to confirm the purchase. This email is an acknowledgement of the purchasing contract between You and us.
We shall retain the right to cancel any purchase made by the Buyers for legitimate grounds such as, for example, if we are not able to process their payment or if the Original Seller withdraws its offer or cannot send the Item within the allotted time. In such cases, and should we have already received payment, we will (i) notify Buyers and (ii) refund the purchase amount using the same payment method that Buyers used when they placed their order. If for any reason the refund has to be made in another way, we will contact Buyers to ensure that the refund can be made.
You understand and agree that the photos of the Items for sale on the Site have no contractual value
4. SHIPPING AND DELIVERY
The original Seller, using the prepaid label given by NOVA Mapo, shall aim to dispatch the Item(s) within one (1) to four (4) working days following the confirmation email.
Buyers will receive a shipping confirmation email once their parcel has been dispatched, indicating an estimation of the time of delivery. The promised delivery time starts from the moment You receive Your confirmation email. Our carriers will make every effort to deliver Your order within the promised delivery time. Nevertheless, delays are sometimes inevitable. Please contact our customer service if You have not received Your parcel within the promised delivery time. If the delivery time is expected to exceed thirty (30) days, You have the right to cancel the purchase.
You must provide us with complete and accurate delivery address information as we cannot guarantee that we will be able to amend it after purchase. Buyers are solely responsible for any error of delivery due to a lack of information or error on the delivery address while placing the order.
Our carriers do not deliver on weekends and public holidays.
Risk and ownership shall be transferred to You once the products are in Your possession.
Should Your parcel be delivered to a specific delivery point, You agree to pick up said package within the time specified in the delivery notification. Packages shall normally be retrieved personally with valid identification and order number. If You do not collect Your parcel in time, Your order will be sent back to us and fully refunded.
Our carriers do not deliver on weekends and public holidays. Please note delivery of Your order may take longer during sale or other busy periods.
5. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
5.1 As a consumer You always have 14 days right of withdrawal.
5.2 Right of Withdrawal
5.2.1. You have the right to withdraw from a contract with us within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which You acquire, or a third party other than the carrier and indicated by You acquires, physical possession of the Items You purchased.
To exercise the right of withdrawal, You must inform us of Your decision to withdraw from this contract by an unequivocal written statement. Please contact us.
To meet the withdrawal deadline, it is enough for You to send Your communication concerning Your exercise of the right of withdrawal before the withdrawal period has expired.
5.2.2 Effects of withdrawal. If You withdraw from a contract with us and/or return any items, we shall reimburse You all payments received from You, including the costs of delivery (with the exception of the supplementary costs resulting from Your choice of a type of delivery other than our standardised delivery method offered by us), minus the return freight cost (that are included in the return label you’ll be given).
Refund shall be made without undue delay and in any event not later than 14 days from the day on which we are informed about Your decision to cancel or until we have received from You evidence that the Item has been sent, whichever is the earliest. You must return the Items You no longer want not later than 14 days from the day on which You. We will carry out such reimbursement using the same means of payment as You used for the initial transaction, unless You have expressly agreed otherwise. Be advised that we shall not bear the costs of returning the Items. Below tables show the freight costs You will need to pay.
We are permitted by law to reduce Your refund to reflect any reduction in the value of the Items, if this has been caused by Your handling, including any loss or damage that occurs during transit.

-For Germany: 4,95 EUR
5.3 We do not offer exchanges for returned Items. If You wish to purchase a new Item, please place a new order.
6. LEGAL GUARANTEE OF CONFORMITY
If You have received Items that do not match the Item information displayed on the Site, You should immediately notify us and send us pictures proving the defect.
Buyers must act within a reasonable period of noticing the defect but there is no specific deadline other than the legal prescription period of 3 years. A complaint made within 2 months is always considered to have been made within a reasonable time frame.
7. PRIVACY POLICY
Once an Item has been purchased on the Site, the Buyers agree to their last name, first name and postal address to be disclosed to the Original Seller.

8. LIMITATION OF LIABILITIES AND WARRANTIES
We make no warranties in relation to this Site and the Service or the information, materials, contents made available. We do not warrant that the Site and/or the Service will be continuously available, or the information on this Site is true, non-misleading or accurate.
Any information and contents on the Site should not be construed as NOVA Mapo giving advice of any kind.
You agree not to use any of the Items for any commercial and/or business purposes, and we exclude liability for loss of revenue/profits, loss of contracts, loss of business, loss of opportunity or loss of reputation. Our maximum liability to You for any loss or damage arising in connection with Your purchase on the Site shall be limited to the total price of Your order.
9. ASSIGNMENT
NOVA Mapo reserves the right to transfer, transfer or pledge all services, liabilities or claims in connection with payments and other services to third parties.
10. LAWS AND DISPUTES
Provisions set in Section II are governed and construed in accordance with Swedish laws.
Contracts between NOVA Mapo and Buyers concluded through the Site as well as any dispute arising out or in connection from them shall be governed by Swedish law. An amicable solution (through an ombudsman system) shall be considered before any judicial remedies. In the event where this solution would fail, Swedish courts shall have a non-exclusive jurisdiction to settle any disputes arising out from these Terms and Conditions. This provision shall not deprive European consumers from their national statutory rights.
In addition, and should You not be able to settle any dispute with NOVA Mapo, You can also submit a complaint to the EU’s online dispute resolution platform. The Online Dispute Resolution platform is available via the following link: http://ec.europa.eu/odr.
In the event of a dispute or claim associated with these Terms and Conditions, we will comply with the decision of the Swedish National Board for Consumer Complaints or the corresponding authority in the respective country.

SECTION III – CIRCLE – SELLING TERMS & CONDITIONS
These Selling Terms and Conditions govern the selling of second-hand Items on the Site.
If You are a Buyer, please check our Buying Terms and Conditions (see Section II)
1. GENERAL
NOVA Mapo provides a free online feature through which our customers can buy and sell second-hand items previously bought on the Site. The Service is an online venue for individuals for buying and selling pre-used NOVA Mapo items (hereinafter the “Items”). The below provisions, and all other relevant conditions set in Terms, are applicable to all Original Sellers (hereinafter “You”) and define the terms and conditions on which NOVA Mapo provide access to the Service and allow them to sell Items.
During the performance of this online intermediary Service, You acknowledge that NOVA Mapo’s role is to act as an active intermediary between Users. Sellers therefore agree to use our payment and shipping services and agree to the terms related to such transactions. You hereby agree that the purchase transaction will be made between You and NOVA Mapo and that payment will be carried out in cash points.
The Service allows (i) You, Original Sellers, to list Items on the Site, and (ii) Buyers to buy such Items.
You acknowledge and agree that, by accessing or using the Service, You are indicating that You have read, understood and agreed to be bound by these Terms. If You do not agree to these Terms, You shall restrain using the Service.
The Service is intended solely for persons over the age of 18 years old. If You are under 18 years old, Your parent or guardian shall be responsible for supervising Your use of the Service at all times and ensuring that You comply with these Terms.

Business sellers are not authorized to use the Service. By using the Service You warrant that You are not a business seller.
You warrant that any information You provide to us is true, accurate and complete. Please consult our Privacy Policy to check what information we process.
2. RULES FOR LISTING ITEM FOR SALE
NOVA Mapo do not pre-vet any Items listed by the Original Sellers on the Site. You therefore agree to not set for sale and ship to Buyers:
- Counterfeit/imitation/replica or fake Items;
- Stolen, fraudulent Items ;
- Products infringing on third party intellectual property rights;
- An Item of the same style but in different colour;
- An item of the same style but in different size;
- Items not previously bought on the Site;
- Items that are not hygienic condition, free from soiling;
- Items that are not free from infestations, such as insects, larvae and other live organisms.
- Items that are not free from stains (food or others) and/or holes in the fabric.
You represent and warrant that the Item is free of any liens or encumbrances. By setting for sale an Item, You agree to indemnify NOVA Mapo from all claims or losses sustained by NOVA Mapo as a result of any breach of these representations and warranties.
Each Item You wish to sell must be listed separately in Your account.
The following categories of Items shall not be allowed to be listed and sold via the Service – NOVA Mapo reserves the right to update this list at any time.
- Cosmetic products;
- Underwear and bottoms items;
- Swimwear.
You must be the legal owner of every Item You list and therefore have the right to sell them.
To list Items, You will be required to complete a quick placement questionnaire. By listing an Item, You represent and confirm that the Item complies with (i) all aspects of the Item questionnaire and (ii) above restrictions.
You may remove any listing via which You offer an Item for sale at any time before You have entered into an agreement to sell said the Item.
3. SELLING PROCESS
3.1 In order to access the Service and start selling Items, Original Sellers must log in to their account at novamapo.com. All Items available to list for sale shall appear in “My Wardrobe” on the Original Sellers’ account at novamapo.com.
In order to set an Item for sale, Original Sellers shall be required to complete a webform in order to submit the Item for sale. You agree to provide us with accurate and complete details of the Items and shall be responsible for the accuracy and completeness of the information provided in said webform.
3.2. By setting up an Item for sale, NOVA Mapo shall try, to the best of its abilities, to find a buyer. Nevertheless the foregoing, NOVA Mapo does not guarantee that a buyer will be found.
You can withdraw Your consent to set Your item for sale at any moment before You accept NOVA Mapo’s purchase offer.
The Seller hereby agrees that professional buyers, pre-selected by NOVA Mapo, might purchase the Items.
3.3 Once a buyer has been found by NOVA Mapo, You will receive a notification. You shall have twelve (12) hours to accept the sale offer.
If You do not accept the purchasing offer from NOVA Mapo within the aforesaid time window, NOVA Mapo will cancel the purchasing offer and You will lose the sale.
3.4 Once You accept the purchase offer from NOVA Mapo, You acknowledge and agree to enter into a purchasing agreement with NOVA Mapo to purchase the Item. By clicking on ”Confirm sale”, You agree:
- To send the Item on behalf of NOVA Mapo within four (4) days;
- To accept the Price offer from NOVA Mapo stated in the offer summary.
NOVA Mapo shall then agree to (i) pay You with cash points, to be redeemed on the Site and (ii) offer You free shipping.
You agree that clicking on ”Confirm Sale” shall constitute a final acceptance to the Offer from NOVA Mapo. You therefore accept NOVA Mapo’s offer price and all other obligations set herein in the Selling Terms and Conditions.
4. SENDING THE ITEMS
4.1 By clicking on “Confirm Sale”, You accept to be responsible for shipping the Item.
4.2 NOVA Mapo shall always bear all shipping costs related to the transaction. We shall forward You all relevant instructions for shipping the Item.
4.3 You shall be responsible for all packaging, labeling and associated tasks for shipping the Item. You must ensure that all Items are shipped in a closed parcel, suitable for the size of the Item and with appropriate strength for the weight, value and characteristic of the Item and that reasonably protects the Item from damage or breakage. You cannot send the Item in a travel bag or suitcase.
NOVA Mapo provides a free shipping label based on the weight of the Item. Should the total weight of the parcel exceed 20% of the Item weight, You hereby agree to pay all additional charges on surplus that may be asked by the carrier. NOVA Mapo shall not be entitled to refund You above additional shipping charges.
4.4 You agree to follow all shipping instructions given by NOVA Mapo and to ship the Item within four (4) days.
4.5 Should You fail to ship the Item within the above given allotted time, NOVA Mapo shall have the right to unilaterally cancel its purchase. The shipping label shall subsequently be cancelled and You will not receive any payment.
4.6 Upon receipt of the Item, the Item will be manually inspected in order to assess condition, authenticity and any undeclared damage. If the Item is severely damaged, is in bad condition or does not match the Item submission, the Item will be deemed unfit for purchase and returned to You at the address provided by You at Your own cost and we shall not proceed with payment of Your cash point.
4.7 Following a successful inspection of Your Item, NOVA Mapo shall send You a Payment Confirmation email. Your cashpoint will then be added to Your NOVA Mapo cashpoint wallet within three (3) days.
5. PAYMENT & CASH POINTS REDEMPTION
5.1 You hereby agree that You shall not receive any cash payment for the sale of Your Item. NOVA Mapo shall credit Your NOVA Mapo cashpoint wallet with the Offer price amount within three (3) days of successful inspection.
5.2 You hereby confirm that You understand that the cashpoint payment can only be redeemed on the Site. Cashpoint cannot be exchanged for cash.
5.3 NOVA Mapo Cashpoints are valid for a period of 48 months from the date of payment, after which any remaining balance will be removed and the NOVA Mapo Cash Points will become invalid and no longer available for use.
6. PENALTIES
6.1 If an Original Seller chooses to violate any of the Service rules set herein, we reserve the right to either delete the listing, block access to the Service for an unlimited period of time or refuse to pay any purchase order to the Original Seller.

You also hereby warrant to NOVA Mapo that (i) you are over 18 years of age, (ii) You have the legal right to sell the Items, (iii) all information You submit are complete, accurate and truthful, and (iv) the listed Items follow NOVA Mapo listing rules set in 2.1 of the present Selling Terms.
9. MISCELLANEOUS
9.1 NOVA Mapo reserves the right to transfer, transfer or pledge all services, liabilities or claims in connection with payments and other services to third parties.
9.2 Should any provision of this Agreement be held by a court of competent jurisdiction to be illegal, invalid or unenforceable, such provision may be modified by such court in compliance with the law giving effect to the intent of the Parties and enforced as modified. All other terms and conditions of this Agreement shall remain in full force and effect and shall be construed in accordance with the modified provision.
9.3 These Selling Circle provisions are governed and construed in accordance with German laws.
